Overview
Burr & Forman works with clients to develop and implement comprehensive risk management strategies to protect interests internally, before governmental agencies, and in court when necessary.
Passage of the False Claims Act, Sarbanes-Oxley, Dodd-Frank, and other legislation enabling whistleblowers to obtain a percentage of government fines and penalties have caused a significant increase in whistleblower and retaliation claims in recent years. Whistleblower claims brought by high level managers can frequently involve significant reputational attacks upon employers causing media relations distractions throughout the duration of the dispute.
Our team also assists clients who wish to proactively develop, implement, or revise codes of conduct, training materials, certificates of completion, and corresponding receipts or acknowledgements. Our attorneys provide training programs for management or broader employee groups with the intended goals of early detection of potential claims and risk mitigation.
Historically, retaliation claims have primarily concerned employment issues, but these matters are now encompassing other legal areas in today’s litigation-rich environment. Our experienced labor and employment attorneys utilize a multi-disciplinary approach to investigate whistleblower and retaliation claims by involving litigation, health care, corporate, environmental, OSHA, and tax attorneys as needed.
